In January 2021, a lawsuit alleged that Mike Miske’s Kamaaina Termite and Pest Control had failed to pay the rent for a number of parking spaces leased from Kakaako Land Company (“Kamaaina Termite sued for nonpayment of lease rent for Queen Street parking“). That case was dismissed without prejudice in March 2021, probably indicating the complaint had been settled out of court.
But there are a couple of other pending cases against Kamaaina Termite. In March, the company was sued by First Security Insurance of Hawaii, over the cost of damages allegedly done to the Mauna Kea Resort by Kamaaina employees.
According to the complaint, Kamaaina was hired in April 2020 to provide fumigation services at the Mauna Kea Beach Hotel. Kamaaina’s employees allegedly left an unattended hose running on the roof.
“Water pooled on the roof structure and found its way to the structure below through seams fastened by clips in the tenting,” the complaint states.
This lawsuit was put on hold in May, and no further actions have been taken.
In October 2021, Leong Brothers, a Hawaii limited partnership and the owner of the building that Kamaaina Termite had leased since 2001, filed suit claiming unpaid rent of $37,978.45 as of August 31, 2021.
For the ten year period ending December 6, 2020, annual rent for the was set at $59,280 for approximately 3,895 square feet within the building, and a 45.6% of the 10,000 foot lot.
The court record indicates Leong Brothers obtained a writ of possession and took the space back on December 17, 2021, 18-months after Miske’s indictment on federal racketeering charges. The court docket shows the case was dismissed in January without prejudice regarding claimed damages.
Another pending lawsuit against Kamaaina was filed in December 2021. It alleges one of Kamaaina’s trucks struck a 2000 Lexus RX300 that was parked along Kumukahi Place in Hawaii Kai. The incident was caught on video by a security camera set up by the Spinnaker Isle Homeowners’ Association. The truck was located at 559 Kumukahi Place.
Miske had purchased the home at a foreclosure sale.
In another transaction, Kaulana Freitas, a co-defendant in the Miske criminal case now pending in federal court, submitted the winning bid of $1.4 million in a public auction held in mid-2018 for a house on Kumukahi Place in Hawaii Kai. The foreclosure sale came only after years of litigation, and it took more than another year to obtain final court approval of the Freitas bid. After the auction, Freitas disclosed that he had bid on behalf of his designee, Mike Miske, who then took his place as purchaser of the property.
Miske financed the sale, in part, with a $1,050,000 mortgage loan from Home Point Financial Corporation that provided 75% of the purchase price. The property is current assessed for tax purposes at $1,344,400, slightly less than the purchase price.
It was sold earlier this year for $1,850,000 with court approval.
It is not clear whether Kamaaina Termite has assets or insurance to pay any of these claims.
