Miske trial Day 1

These are the court minutes reflecting what took place on Monday, January 8, the first day of the trial of Mike Miske, John Stancil, and Delia Fabro-Miske.

Jurors are coming into court in groups of 10 to be questioned by attorneys and the judge.

This first day of jury selection resulted in 11 of the first 19 prospective jurors being dismissed.

EP: Status Conference and Jury Selection (Day 1) held.

Defendants (1) Michael J. Miske, Jr. and (2) John B. Stancil present, in custody.

Defendant Delia Fabro-Miske present, not in custody.

[8:15 – 8:50] – Status Conference.

Discussions held regarding additional witnesses, exhibit binders and jury instructions.

Jury to print Govt.’s and Defendants’ supplemental witness lists to be redacted [Dkt. Nos. 1223, Exhibit A, 1232 and 1235] and given to the prospective jurors for review prior to individual voir dire.

Parties to provide the Court with a legend as to how the exhibits are numbered.

Parties are ordered to meet and confer to review proposed jury instructions. One set of agreed upon proposed jury instructions, and another set of substantive and non-substantive instructions not agreed upon, to be filed with the Court. Any defense instructions not agreed upon by all defense counsel shall also be included in the Defendants’ set of proposed jury instructions.

Counsel to inform the Court of the agreed upon deadline to file proposed jury instructions pursuant to the Court’s instructions. No further extensions will be granted once a date has been set.

[9:20 am – 1:30 pm] – Jury Selection with the 9:00 a.m. Group.

9 prospective jurors present.

Court addressed all prospective jurors in the group, and gave a brief overview of jury selection and trial process. Prospective jurors moved to the JCR room.

Individual voir dire conducted.

4 jurors excused from the morning session.

Discussion held regarding jury instructions to be read to the jurors prior to opening statements. Parties to confirm if a consensus has been reach as to substantive pre-opening statements proposed by the Government.

[2:15 pm – 5:45 pm] Jury Selection with the 1:00 p.m. Group.

10 prospective jurors present.

Court addressed all prospective jurors in a group, and gave a brief overview of jury selection and trial process. Prospective jurors moved to the JCR room.

Individual voir dire conducted.

7 jurors excused from the afternoon session.

Further Jury Selection (Day 2) set for 1/9/2024 at 9:00 a.m. and 1:00 p.m. in Aha Kupono with Chief Judge Derrick K. Watson.

Defendants (1) Michael J. Miske, Jr. and (2) John B. Stancil remanded to the custody of the U.S. Marshals Services.
