The Star-Advertiser, now the island’s monopoly daily newspaper, duly reported on the lawsuit filed by Monsanto and others seeking to invalidate the Maui GMO law approved by voters (“Monsanto sues over GMO law“). Civil Beat also reported on the filing (“Monsanto, Agrigenetics Sue to Invalidate Maui County GMO Farming Ban“).
One big difference in their competing coverage…CB included a copy of the complaint, so you can read the primary document. The Star-Advertiser, on the other hand, followed their general practice of not providing that kind of value-added touch.

Gotta wonder about HNN placing a picture of a grinning Pres. Obama as a lead-in to the GMO moratorium story. Thus far, the leader of the free world hasn’t involved himself in this matter. So what gives?

Noteworthy too, is the Shaka Movement’s stance that the majority will of the people should prevail over legal and scientific merits, even if that majority was by a sliver.
[We asked Dr. Lorrin Pang, one of the Shaka Movement founders about the legal challenge. Pang responded, “When it goes to a vote, there’s a general acceptance that when it wins, it wins. If you’re going to sue, I guess you should have sued before it went to a vote.”]
Guess Dr. Pang doesn’t realize that his “majority rules” logic doesn’t work for proponents of gay marriage bans if the SCOTUS rules against them. So to it will be for this GMO moratorium.

Unfortunately, the circuit courts do not yet make documents available online. The Monsanto suit is in federal court, which has a document service. By the way, it costs me 10 cents per page to download these documents and make them available to you.

Also, just raising the point that there was an earlier lawsuit from the initiative backers that deserves attention for the notion that Counties should be able to take steps they believe are necessary to protect the health, safety, and welfare of their residents … Many people in Hawaii believe in local government, citizen involvement, local control, and “decentralization.”
I would hope that people can see that it is odd to say for the Federal courts to claim that local governments somehow do not have the “power” to regulate activities (on thousands of acres of land right next to schools, etc…) that clearly have the potential to affect land, air, and water – and thus human health.
